1. Acceptance of Terms

By using Junk Rascals' services, booking through our website, or contacting us for junk removal, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

Junk Rascals provides junk removal and hauling services in Kentucky and surrounding areas. Our services include, but are not limited to, household junk removal, construction debris removal, appliance disposal, yard waste removal, and light demolition.

3. Pricing and Payment

3.1 Guaranteed Upfront Pricing

Guaranteed upfront pricing (item-by-item pricing) is not available in all service areas. Availability of this pricing option depends on your location and will be indicated during the booking process. Where guaranteed pricing is available, the price quoted is final, provided that the items and conditions match what was specified during booking.

3.2 Load-Based Estimates

Load-based pricing estimates are subject to on-site confirmation. The final price may vary based on the actual volume, weight, type of items, accessibility, and disposal requirements. Our team will provide a final quote on-site before beginning work. You are not obligated to proceed if you do not accept the final quoted price.

3.3 Payment Terms

Payment is due upon completion of services unless other arrangements have been made in writing. We accept major credit cards, debit cards, and cash. All prices include labor, transportation, and standard disposal fees unless otherwise noted.

3.4 Additional Fees

Additional fees may apply for: hazardous materials disposal (if accepted), excessive weight, difficult access requiring special equipment, after-hours service, or items requiring special handling. Such fees will be disclosed before work begins.

4. Service Limitations and Exclusions

4.1 Hazardous Materials

We do NOT remove hazardous materials including but not limited to: asbestos, chemicals, fuels, oils, paint (wet), propane tanks, medical waste, radioactive materials, or any items classified as hazardous waste. Customer is responsible for identifying and disclosing any potentially hazardous materials prior to service.

4.2 Safety and Accessibility

We reserve the right to refuse removal of any items that:

• Pose a safety risk to our crew or property
• Are in locations that are unsafe or inaccessible
• Require specialized equipment we do not have available
• Violate local, state, or federal regulations for transport or disposal
• Exceed weight limits for safe handling
• Are structurally integrated into the property (without proper demolition permits)

4.3 Property Access

Customer must provide clear and safe access to all items to be removed. We are not responsible for damages caused by pre-existing property conditions, hidden defects, or inadequate access. If access requires moving or temporarily relocating other items, additional fees may apply.

5. Service Provider Referrals

Junk Rascals directly provides services in select areas. In other service areas, we may refer your request to independent third-party junk removal companies who operate their own separate businesses. These companies pay us a referral fee to connect them with customers in their area.

When your service request is referred to a third-party company:

• That company is a separate legal entity with no employment, agency, or contractual relationship with Junk Rascals
• That company sets its own pricing, policies, and terms of service
• That company is solely responsible for the quality and performance of services
• That company maintains its own insurance and licensing
• These Terms of Service do not apply to services performed by third-party companies

You will be notified if your service request is being referred to a third-party provider.By accepting service from a referred provider, you acknowledge that Junk Rascals:

• Is not responsible for the acts, omissions, pricing, or quality of service provided by the third-party company
• Makes no warranties or guarantees regarding services performed by third-party providers
• Is not liable for any damages, disputes, or issues arising from services performed by third-party providers
• Acts solely as a referral service and is not a party to any agreement between you and the third-party provider

Any disputes regarding services provided by a referred third-party company must be resolved directly with that company according to their own terms and policies.

6. Booking and Cancellation

6.1 Booking

Bookings can be made online, by phone, or through our booking system. All bookings are subject to availability. We will confirm your appointment by email or phone.

6.2 Cancellation by Customer

Customers may cancel or reschedule appointments up to 24 hours before the scheduled service time without penalty. Cancellations made less than 24 hours before the appointment may incur a cancellation fee of up to $50.

6.3 Cancellation by Junk Rascals

We reserve the right to cancel or reschedule appointments due to weather, equipment failure, safety concerns, or other circumstances beyond our control. We will make reasonable efforts to notify you as soon as possible and reschedule at your convenience.

7. Customer Responsibilities

Customer agrees to:

• Accurately describe all items to be removed during booking
• Disclose any known hazards or special conditions
• Ensure legal authority to remove items from the property
• Secure or remove any valuable items not intended for removal
• Provide accurate access information and be present or available during service
• Ensure pets are secured during service
• Inform us of any building or property restrictions

8. Liability and Insurance

8.1 Our Liability

Junk Rascals carries general liability insurance. We take care to prevent property damage, but are not liable for damage to property due to pre-existing conditions, hidden defects, normal wear and tear, or circumstances beyond our control. Any claims for damage must be reported within 48 hours of service completion.

8.2 Limitation of Liability

Our liability for any claim related to our services is limited to the amount paid for those services. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption.

8.3 Customer Indemnification

Customer agrees to indemnify and hold harmless Junk Rascals from any claims, damages, or expenses arising from: (a) items that customer did not have authority to dispose of, (b) hazardous materials not disclosed by customer, (c) inaccurate information provided by customer, or (d) customer's violation of these terms.

9. Disposal and Recycling

We make reasonable efforts to recycle, donate, or dispose of items in an environmentally responsible manner in accordance with local regulations. However, we cannot guarantee that all items will be recycled or donated. Final disposal methods are at our discretion based on item condition, local facility availability, and applicable regulations.

10. Warranties and Disclaimers

Our services are provided "as is" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our services will meet your specific requirements or be completed within a specific timeframe.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, both parties agree to first attempt to resolve the matter informally by contacting us directly. Many issues can be resolved quickly through direct communication.

11.2 Arbitration

If informal resolution is unsuccessful, any disputes arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Casey County, Kentucky. Each party shall bear its own costs and fees.

11.3 Class Action Waiver

You agree to resolve disputes with us only on an individual basis and not as part of any class, consolidated, or representative action.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky without regard to conflict of law principles. Any legal action must be brought in the courts of Casey County, Kentucky.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Junk Rascals regarding our services and supersede all prior agreements, understandings, and communications, whether written or oral.
